Random Drug Testing Policy for Commercial Driver's License (CDL) Drivers

Purpose
This policy establishes guidelines and procedures for random drug testing of Commercial Driver's License (CDL) holders to ensure compliance with Department of Transportation (DOT) regulations and maintain workplace safety. Testing requirements aim to prevent accidents and injuries resulting from the use of controlled substances or alcohol. Our company promotes a drug-free workplace environment that protects both employees and the public.

Scope
This policy applies to all employees who operate commercial motor vehicles requiring a CDL as part of their job duties and safety-sensitive functions. Any employee who holds a CDL and operates company vehicles must participate in the random drug testing program regardless of their job title or position. The policy covers testing procedures, consequences, and compliance requirements as mandated by federal regulations.

Policy:

Testing Procedures:
All CDL drivers will be subject to random drug and alcohol testing using a scientifically valid method of selection to ensure each driver has an equal chance of being chosen. Testing will be conducted at a frequency mandated by DOT regulations, with a minimum percentage of the driver pool tested annually. Designated testing facilities will follow proper chain of custody procedures and use only DOT-approved testing methods to ensure accurate results.

Testing Frequency:
Random drug tests will be conducted quarterly with a minimum of 50% of the total driver pool tested annually for drugs and 10% for alcohol, as required by DOT regulations. Testing dates and times will be unannounced and reasonably spread throughout the calendar year. Selected drivers must proceed immediately to the testing site upon notification.

Collection Procedures:
All specimen collections will be conducted in accordance with DOT protocols by trained collection site personnel. Split specimen collections will be used for all drug tests, providing drivers the opportunity to request testing of the split specimen at a different laboratory. Collection sites will maintain proper security and documentation throughout the collection process.

Consequences of Positive Results:
Drivers who test positive for prohibited substances will be immediately removed from safety-sensitive functions and referred to a Substance Abuse Professional (SAP) for evaluation. Return-to-duty protocols will require successful completion of any recommended treatment program and a negative drug test before resuming safety-sensitive duties. Multiple violations may result in termination of employment, in accordance with company policy and DOT regulations.

Return to Duty Process:
Drivers must complete all SAP-recommended treatment programs and education requirements before being considered for return to duty. A negative return-to-duty test is required, followed by a minimum of six follow-up tests in the first twelve months. The SAP may require follow-up testing for up to 60 months.

Refusal to Test:
Any refusal to submit to required testing will be treated as a positive test result. Refusal includes failure to appear for testing, leaving the testing site before the test is complete, failure to provide adequate specimens, and tampering with specimens. Drivers who refuse testing will be subject to the same consequences as those who test positive.

Confidentiality:
All drug testing results and related information will be maintained in confidential files separate from general personnel records. Access to testing records will be strictly limited to authorized personnel with a legitimate need to know. The company will comply with all privacy requirements while meeting DOT reporting obligations and maintaining required documentation.

Record Retention:
Testing records will be maintained according to DOT requirements: negative test results for one year, positive results for five years, and annual summaries for five years. Records related to the collection process will be maintained for two years. Documentation of driver training and supervisor training will be kept for two years after the employee leaves the company.
